Amendment C270yara and Extensions – Fitzroy Collingwood Stage 1 Interims

 

About the amendments

The Minister for Planning has approved two amendments that introduced (C270yara) and extended (C313yara) interim built form controls for Fitzroy Collingwood Stage 1 (DDO30, DDO35, DDO36 and DDO37).

The interim controls were first introduced into the Yarra Planning Scheme on the 27 August 2021 via Amendment C270.

The latest amendment, C313yara, gazetted on 24 February 2023, extends the interim controls until Friday 21 April 2024, while permanent controls are being considered.

Are we seeking permanent controls?

Draft Amendment C271yara has been forwarded to the Minister for Planning seeking consent to place permanent DDOs for Fitzroy and Collingwood on formal public exhibition.

Amendment C270yara 

Under delegation from the Minister for Planning, the Department of Environment, Land, Water and Planning (DELWP) decided to approve Amendment C270yara with changes. The Amendment came into effect on 27 August 2021.

Out of the 9 interim Design and Development Overlays (DDOs) that were requested by Council (see Further Information below), the following four interim DDOs were approved, with changes:

According to the approval, “It has been demonstrated these areas are experiencing development pressure, warranting introduction of interim controls.” A decision on the other requested interim DDOs was not made.

 Key changes that were made to the requested interim DDOs are:

  • The approved interim DDOs include no mandatory controls – all built form requirements (this change is most relevant to interim DDO30, 35 and heritage properties in interim DDOs 36 and 36) and overshadowing requirements (this change is relevant to all interim DDOs) are preferred;
  • Additional conditions to assess proposals that intend to exceed preferred heights were not included; and
  • Interim DDO30 is no longer applicable to Victoria Street, west of Brunswick St.

Amendment C313yara

Amendment C313yara extended the interim planning controls for numerous DDO’s in Fitzroy and Collingwood including DDO38, DDO39 and DDO40 until 21 April 2024.

What are Design and Development Overlays?

The Design and Development Overlay (DDO) is a planning control that is applied to land which requires a specific design treatment. The purpose of the overlay is to give direction to the specific design and built form requirements.

These includes but is not limited to:

  • Street wall height
  • Setbacks
  • Overall building height
  • Rear interface design
  • Overshadowing
  • Building design
  • Transport access and design.

What stage is this amendment at?

The Minister for Planning (under delegation) exercised her powers under section 20(4) of the Planning and Environment Act 1987 to prepare, adopt and approve the latest amendment, Amendment C313yara.   

Notice of approval was published in the Victoria Government Gazette on 24 February 2023 and the changes to the Planning Scheme have now come into effect.
