AMENDMENTS C248, C249 AND EXTENSIONS - BRIDGE ROAD AND VICTORIA STREET INTERIMS

About the amendments

The Minister for Planning has approved a series of Amendments that introduced (C248 and C249) and extended (C284yara, C290yara, C305yara and C315yara) interim built form controls for Bridge Road (DDO21) and Victoria Street (DDO22).

The interim controls were first introduced into the Yarra Planning Scheme on 15 November 2018 via Amendments C248 and C249.

The latest amendment, C315yara, gazetted on 30 March 2023, extends the interim controls until 2 October 2023, while the permanent controls are being considered by the Minister for Planning.

Are we seeking permanent controls?

Draft amendment C291yara proposes to introduce permanent planning controls to Bridge Road and Victoria Street and some surrounding areas. The process to consider permanent controls has now closed. Council determined at its Meeting on 2 August 2022 to request the Minister for Planning to approve Amendment C291yara in the Council's preferred form. C248 and C249

Amendments C248 (Bridge Road) and C249 (Victoria Street) introduced interim controls to the Yarra Planning Scheme in November 2018.

The four amendments to extend the interim planning controls for DDO21 and DDO22 since their introduction include: C284yara (which extended the controls until 1 October 2020), C290yara (24 June 2021), C305yara (16 June 2022) and C315yara, the most recent amendment (which expires on 2 October 2023).

What are Design and Development Overlays?

The Design and Development Overlay is a planning control that is applied to land which requires a specific design treatment. The purpose of the overlay is to give direction to the specific design and built form requirements.

This includes but is not limited to:

  • Street wall height
  • Setbacks
  • Overall building height
  • Rear interface design
  • Overshadowing
  • Building design
  • Transport access and design

What stage is this amendment at?

The Minister for Planning (under delegation) exercised her powers under section 20(4) of the Planning and Environment Act 1987 to prepare, adopt and approved the latest amendment, Amendment C315yara.

Notice of approval was published in the Victorian Government Gazette on 30 March 2023 and the changes to the planning scheme have come into effect.
