What is the Development Contributions Plan?

Yarra Development Contributions Plan. How much do I pay in development contributions? Do I need to pay DCP levies?

The Development Contributions Plan (DCP) was introduced on 1 February 2021. It’s a levy to fund essential infrastructure due to population growth resulting from new development.

The DCP levy applies for developments that are looking to:

  • Increase the number of dwellings on a site, and/or
  • Increase the retail, commercial or industrial floor area on a site

Mixed-use developments must pay the associated DCP levy for each component of the development. The levy varies depending on the area the development is in.

There are two parts to the DCP levy

  1. The Development Infrastructure Levy (DIL)
  2. The Community Infrastructure Levy (CIL)

The DIL applies to all residential, retail, commercial and industrial developments. It helps fund projects such as:

  • Roads
  • Cycling infrastructure
  • Drainage
  • Footpaths
  • Improvements to public areas

The CIL only applies to residential developments and contributes to funding projects including:

  • Childcare centres
  • Maternal and child health centres
  • Recreation and sporting facilities
  • Libraries
  • Neighbourhood houses
  • Public toilets
  • Shared community facilities

Any planning permit applications decided on or after 1 February 2021 need to pay all parts of the DCP levy applicable to the development.

How much do I need to pay?

Development contribution rates are adjusted annually on or about 1 August each year to reflect the annual rise or fall in the Consumer Price Index (CPI).

How do I know what levy amount to pay?

You will receive an invoice confirming the levy due (including a breakdown of DIL and CIL as applicable) when development plans are endorsed.

The DCP levies will be indexed on 1 August annually. Any DCP invoices outstanding on 1 August will be cancelled and re-issued to reflect the new levy rates.

How do I pay the levy?

A planning permit issued on or after 1 February 2021 will set out the requirements for when the levy must be paid.

You can pay:

The levy must be paid before the issue of a building permit for the development. If no building permit is required, then it must be paid before commencing any development works.

If you have applied for subdivision of land, then you need to pay the levy prior to the issue of a Statement of Compliance. If you are staging a subdivision, timing of the payment will be set out in the planning permit for each stage.

Frequently asked questions

For developments with a planning permit or a subdivision Statement of Compliance issued prior to 1 February 2021, then a DCP levy may not apply.

If you are amending an existing planning permit after 1 February 2021, the DCP levy may apply to any additional floor area/dwellings.

Subdivision permits issued on or after 1 February 2021 may trigger the need for payment of the levy prior to the issue of a Statement of Compliance.

  • If the DCP has already been paid, an additional DCP levy will be required based on any further increase in the number of dwellings, or the retail, commercial or industrial floor area
  • If the DCP has not yet been paid, the DCP levy will be recalculated for the revised development and a new invoice issued

There are developments that are exempt from the DCP levy including:

  • Demolition of a dwelling followed by construction of a replacement dwelling on the same land. This exemption applies to a single dwelling but not to a second or subsequent dwellings on the same land
  • Renovation or alteration to an existing dwelling
  • If a building (other than a dwelling) has been unintentionally damaged or destroyed, provided the floor area of the new building is not greater than the damaged or destroyed building
  • Any development on land which forms part of the Former Fitzroy Gasworks development at 111 Queens Parade and 433 Smith Street, Fitzroy
  • Government and non-government schools, public hospitals and properties managed by the Department of Health and Human Services (DHHS)
  • Outbuildings normal to an existing dwelling and fences.

If work has started and a levy has not been paid, you will be in breach of the Planning and Environment Act 1987. Yarra can take action against you, including fines and prosecution.
