The State Government has introduced a new Townhouse and Low-Rise Code. These took affect on 31 March 2025.
The changes apply to planning permit applications for 2 or more dwellings on a lot and residential buildings (1-3 storeys).
What this means for planning permit applications
The new Clause 55 requirements apply to any new planning permit application for 2 or more dwellings on a lot and residential buildings (1-3 storeys) lodged from 6 March 2025. For applications lodged prior to then, the previous version of Clause 55 still applies.
If you want to apply for a planning permit for 2 or more dwellings on a lot and residential buildings (1-3 storeys), you will need to include a written statement which Clause 55 standards are met and which are not met. If a standard is not met, the written statement must include an explanation of how the development meets the corresponding objective having regard to the corresponding decision guidelines. The State Government has provided a template you can use.
If your development complies with every standard that applies, the application will be exempt from third party appeal rights. This means that while it will still go to public notice (advertising), any objectors do not have the ability to appeal Council’s decision to VCAT.

What this means for other parties
If you receive notice about an application for 2 or more dwellings on a lot and residential buildings (1-3 storeys), you will still be able to view the application online. You may still submit an objection or submission if you wish.
However, in the event that the development complies with every standard that applies, you will not have the right to appeal Council’s decision to VCAT.
