Land Subject to Inundation Overlay (LSIO) and Special Building Overlay (SBO) are two overlays which mitigate against flooding, run-off and to ensure the protection of waterways.
Buildings and Works on properties located under the Land Subject to Inundation Overlay (LSIO) and Special Building Overlay (SBO) may require planning permission to mitigate against flooding, run-off and protect waterways.
To check if your property is in SBO or LSIO visit Vicplan and search the property address.
Where a Planning Permit is required for the proposal under the SBO or LSIO, the application must be referred to the relevant floodplain authority who is a determining authority (this is usually Melbourne Water).

- Completed application form, which you will fill in online when you lodge your application
- A recent copy of Certificate of Title from Landata that’s no more than 3 months old, including a full copy of any restrictive covenants or section 173 agreements
- The applicable Fee. Learn more on our fees page
- A covering letter explaining your proposal
- Fully dimensioned site plans and elevation plans prepared by a suitably qualified architect or draftsman drawn to scale. It should also clearly depict:
- Any existing buildings, including fences
- All proposed works and development
- Finished floor levels to Australian Height Datum (AHD)
- Site levels
- Setbacks from all boundaries
- Wall and overall building heights taken from natural ground level at the building line as well at the boundary line
- Relevant ground and floor levels and maximum building height from the natural ground level to Australian Height Datum (AHD)
- The location of any easements
- A feature survey plan prepared by a suitably qualified surveyor
- Details of the car parking and accessway design
- Details of proposed earthworks/areas of cut and fill along with retaining wall and fence details (including details about changes in ground levels)
- Under the SBO you may be eligible for a VicSmart application. However, applications must be submitted to Melbourne Water for consent prior to lodgement to Council. For more information, visit the Melbourne Water’s guide to applying for a permit under the Special Building Overlay
