Learn more about submitting an application for an asset protection permit.

An asset protection permit is needed if you require a building permit.

This permit protects Yarra City Council's assets such as footpaths, roads or street trees from damage.

You may need to pay a bond in addition to the permit cost.

The bond amount will be determined as part of your application. It will be refunded after a final inspection or used to offset the cost of repairs.

Initial assessment of your application can take up to 7 business days. A permit cannot be issued until all documentation has been supplied.

An asset protection permit is required for the entire project including demolition and construction.

Applications are submitted online. There are three easy steps to follow:

Frequently asked questions

The person in charge of the building works at the site, typically the owner/developer or builder.

Once you have submitted your application it will be sent to the permits team.

You will receive an automatic confirmation with an application number. Please keep your application number handy, as this will be needed for any future correspondence.

You will be notified once the assessment is complete, this will include the cost of permit and if a bond is required.

Yes, there will be three inspections:

  • before works start to assess the existing condition
  • during the works
  • at the completion of your works.

The permit fee is based on the cost of your overall works and is not refundable:

  • Free for works up to $10,000 (permit still required)
  • $281.21 for works between $10,001 and $500,000
  • $846.87 for works over $500,000

There are drainage inspection fees for Construction Management Plan (CMP) sites.

Pre- and post-construction CCTV footage of the existing drainage assets is required for CMP sites.

We will invoice you for both inspections at the application stage. If cleaning is required for the pre-construction CCTV inspection, we will pay for and complete the cleaning.

You must also provide CCTV footage for any new drains or pits being installed.

The following fees apply:

  • Organising CCTV inspection (includes pre and post) – $314.00
  • CCTV inspection – $268.49 an hour ($800 minimum charge/per inspection)
  • Traffic management (if required) – $298.31 an hour with a four-hour minimum charge ($1193.24)

The following fees apply if drain or pit cleaning is required at the post-construction inspection:

  • Organising cleaning – $172.95
  • Cleaning – $283.43 an hour ($800 minimum charge)
  • Traffic management (if required) –$298.31 an hour with a four-hour minimum charge ($1193.24)
  • Tipping fees (if required) – $221.9 per tonne

We will determine an estimate for cleaning costs when assessing the asset protection permit. This will be included in the security bond.

We assess the bond on a case-by-case basis. This will involve a site inspection.

Minimum bond determinations:

  • All works $5,000
  • Works which include Concrete Drainage $15,000 (minimum) – CMP Sites
  • Works which include Brick Drainage $50,000 (minimum) – CMP Sites

After the inspection, we will refund your bond if we are satisfied no damage has occurred.

We will issue you with an invoice. This can be paid by cash, cheque, credit card or bank guarantee.

If you are providing a bank guarantee, your bank needs to include the following information:

  • site address
  • company details
  • description of works
  • Asset Protection Permit number
  • amount of guarantee
  • expiry date – we don't accept unconditional bank guarantees or bank guarantees with an expiry date.

The permit is issued for two years. Extensions can be granted, subject to an assessment by an asset protection officer.

The permit expires if building works do not commence within 12 months of the permit being issued.

The final inspection will be conducted when all the building, construction, and associated works are completed.

You need to attach your Regulation 1005 Occupancy permit or Regulation 1006 Certificate of final inspection from your building surveyor.

Provided there has been no damage to our assets, we will return the security bond or bank guarantee to you in full when the building works are completed.

After the final inspection, we will release your bank guarantee or request your bank account details and a copy of your bank statement to confirm your account details (for amounts over $10,000) and process the bond refund.

Depending on the scope of works, some discretion is applied. This may include:

  • essential safety measures - fire service upgrade, fire hose reels, smoke alarms
  • public housing covered by Department of Health and Human Services
  • internal fit outs within established hospitals, shopping centres, universities
  • unit fit outs within multi storey buildings
  • pool safety barriers
  • internal stairways, awning, balustrades
  • fit outs within established business parks with no impact to our assets
  • where vehicles and equipment are located on private property using an existing vehicle crossing and there is no occupation of Council land.
