Yarra City Council proposes to discontinue the roads abutting 73 Amess Street, Carlton North
PROPOSED ROAD DISCONTINUANCE
PUBLIC NOTICE INVITING SUBMISSIONS UNDER SECTION 223
Yarra City Council (Council), acting under clause 3 of schedule 10 to the Local Government Act 1989 (Act), proposes to discontinue the roads abutting 73 Amess Street, Carlton North, being the:
(a) 31m2 parcel of land shown cross-hatched and identified as ‘lot 2’ on the plan below, being all of the land contained in certificate of title volume 1642 folio 322 (Lot 2);
(b) 15m2 parcel of land shown cross-hatched and identified as ‘lot 1’ on the plan below, being all of the land contained in certificate of title volume 2706 folio 028 (Lot 1),
(together, Roads).
The proposal is that Council discontinue the Roads and sell them to the owner of the adjoining property at 73 Amess Street, Carlton North (Owner) for market value. Public rights of access over the Roads will be extinguished, however, at the request of the Owner and the adjoining owners, Council has agreed to grant a private carriageway easement over Lot 1 in favour of the land at 90 and 94 Macpherson Street, as a condition of the sale of the Roads to the Owner.

Any person may make a submission on the proposal.
Any person wishing to make a submission under section 223 of the Act must do so in writing by Friday 14 August 2026.
All submissions will be considered in accordance with section 223 of the Act. Submissions should be addressed to the Chief Executive Officer, and may be sent as follows:

Any person requesting to be heard in support of their submission is entitled to be heard before Council (or its committee established by Council for this purpose) or be represented by a person acting on their behalf and will be notified of the time and date of the hearing. Anyone wishing to speak must clearly state this request in their written submission.
