What does this amendment do?
Amendment C210 proposes to update the Special Building Overlay (SBO) in the Yarra Planning Scheme.
The existing SBO has been in the planning scheme since 2000 and shows the location and extent of land affected by overland flooding in a 1 in 100 year storm
The overlay triggers the need for a planning permit for buildings and works and referral to Melbourne Water for review.
Melbourne Water has updated its mapping of the SBO in Yarra and has requested that the planning scheme maps be updated.
The approximate number of properties affected are:
1200 properties are proposed to be added to the overlay.
300 properties are proposed to be removed from the overlay.
1100 properties currently included in the overlay will have the extent of the overlay changed.
Interim Special Building Overlay measures
We introduced interim SBO measures to all properties identified in Amendment C210.
This means that if you apply for a planning permit to undertake building works on your property prior to the amendment being introduced, the application will be referred to Melbourne Water for comment.
We will consider Melbourne Water’s comments when deciding the planning permit application.

Consultation with the public on this amendment
The amendment was publicly exhibited from 24 October to 2 December 2016.
We wrote to all affected residents and property owners inviting submissions to the amendment. We also held two community information sessions in early November 2016.
In February, Council resolved to refer the submissions to an independent planning panel.
Council considered the panel report for the amendment and adopted it on 15 August 2017. You can read the officer report and minutes here. The amendment has been submitted to the Minister for Planning for final approval.
Panel found that:
• The amendment is strategically justified
• The flood modelling work undertaken by Melbourne Water is ‘fit for purpose’ and of a level of accuracy appropriate for defining, and in this case amending, the boundaries of the SBO
• The minor changes to the proposed SBO at two properties Fitzroy North should be supported.
• There is no justification for not proceeding with the Amendment on the basis that property values or insurance costs might be affected.
