Amendment C173 – 17 Heritage Precincts

Amendment C173 (Part 2) was approved by the Minister for Planning and formed part of the Yarra Planning Scheme from 4 May 2017.

What is the background to the amendment?

A heritage study undertaken in 2009 identified 20 heritage precincts for possible inclusion into the Yarra Planning Scheme, three of which were incorporated into the planning scheme at that time.  An investigation of the remaining 17 precincts was conducted in 2013 to ensure that the recommendations were still relevant.

The investigation into the 17 precincts formed the basis of Amendment C173.

What land was affected by this amendment?

Part 1 of the amendment applied to properties in Smith Street (south) in Collingwood.

Part 2 of the amendment applied to properties in the northern part of Richmond, Burnley and Cremorne.

Why are there two parts to the amendment?

The amendment was divided into two parts following its public exhibition.  No submissions were received in relation to the Smith Street properties.  Council adopted that part of the amendment as Part 1. As there were no submissions received, the Smith Street properties were not referred to a panel and were submitted directly to the Minister for approval. 

29 submissions were received which were heard during through a panel process on 29 April to 1 May 2015 and the 8 March 2016. The report was released on the 12 July 2016 with a series of recommendations which were brought to Council on the 19 September 2016. A Council resolution was made to seek approval from the Minister with the changes recommended in the Panel Report.

What did this amendment do?

The amendment was required to formally protect places of local heritage significance in the Yarra Planning Scheme and to implement the findings of the Heritage Gap Study: Smith Street South, July 2014 and Heritage Gaps Study: Review of 17 Heritage Precinct, August 2014 (revised October 2016).

Council adopted Amendment C173 (Part 1) at its meeting on 17 February 2015 and (Part 2) at its meeting on 19 September 2016.
