On the 10 April 2018 Victorian Civil and Administrative Tribunal (VCAT) set aside Council’s decision and directed to issue a permit for the followoing subject to a number of conditions (see copy of permit and endorsed plans and documents below)

The construction of a building or construction or carrying out of works under clauses 34.02-4 and 43.02-2;
The use of the land for ‘food and drink premises (café)’ as the floor area exceeds 100m2 under clause 34.02-1; and
The reduction in the number of car parking spaces under clause 52.06-3.
