Amendment C288 & Extensions – Fitzroy Collingwood Stage 2 (Interims)

Overview

The Minister for Planning has approved two amendments that introduced (C288yara) and extended (C313yara, C323yara & C332yara) interim built form controls for Fitzroy Collingwood Stage 2 (DDO38, DDO39 and DDO40).

The interim controls for Stage 2 were first introduced into the Yarra Planning Scheme on the 22 October 2021 via Amendment C288yara.

The latest amendment, C332yara, gazetted on 25 June 2025, extends the interim controls until Friday 30 June 2026, while permanent controls are being considered.

Council exhibited the draft amendment from 18 November 2024 - 24 February 2025.

Approval

Under delegation from the Minister for Planning, the Department of Environment, Land, Water and Planning (DELWP) decided to approve Amendment C288yara with changes. The Amendment came into effect on 22 October 2021.

The following interim Design and Development Overlays (DDOs) were approved:

Key changes that were made to the requested amendment are:

  • The approved interim DDOs include no mandatory controls – all built form requirements and overshadowing requirements are preferred:
  • Additional conditions to assess proposals that intend to exceed preferred heights were not included in any of the interim DDOs;
  • Changes from Council Resolutions relating to interim DDOs 38 and 39 (Alexandra and Victoria Parades) were not included:
  • Interim DDOs were approved for 18 months instead of 2 years;

Land affected by this amendment

What are Design and Development Overlays?

The Design and Development Overlay (DDO) is a planning control that is applied to land which requires a specific design treatment. The purpose of the overlay is to give direction to the specific design and built form requirements.

These includes but is not limited to:

  • Street wall height
  • Setbacks
  • Overall building height
  • Rear interface design
  • Overshadowing
  • Building design
  • Transport access and design.
