Amendment C245 was approved by the Minister for Planning and Gazetted 11 February 2021.
Why did we prepared this amendment?
This Amendment was derived from a number of different projects. Recent heritage studies were conducted in Collingwood, Richmond, Fitzroy North and Clifton Hill to inform planning controls. These studies identified a number of gaps in the heritage controls for a number of individually significant buildings. Yarra City Council also maintains a list of errors and anomalies that can be found in the heritage overlay of properties located in Yarra. This Amendment applied recommendations from recent heritage studies and corrects Heritage Overlay and zone anomalies in the Yarra Planning Scheme.

Panel Hearing
The Hearing was held on 22 April 2020.
The Hearing was held via video conferencing and 'on papers' due to the COVID-19 pandemic. The health and safety of all parties and the wider community is paramount in the decision of the Panel to vary the usual hearing process
The Panel considered all referred written submissions when preparing its report, including those from submitters who did not attend the Hearing.

Heritage Studies
This list defines key terms used in Amendment C245. This includes a mapping key for different zones.
Heritage Overlay
Heritage overlays cover identified places of local heritage significance in Yarra. Council implements heritage overlays to protect these places and to maintain the value to the local community.
Heritage gradings
Within the heritage overlay there are 3 gradings:
Significant: Significant heritage places are individually important places of state, municipal or local heritage significance. They may be both individually significant and significant in the context of the heritage of the precinct.
Contributory: Contributory heritage places are places that contribute to the cultural heritage significance of a precinct and have been given this status in a heritage study. They are not considered to be individually important places, however when combined with other significant and/or contributory heritage places, they play an integral role in demonstrating the cultural heritage signature of the precinct.
Non-contributory: Non-contributory places are places within a heritage precinct that have no identifiable cultural heritage significance. They are included within a heritage overlay because any development may impact on cultural heritage significance of a precinct or adjacent heritage places.
Heritage Overlay numbers eg. HO121
These codes are used to identify a place of significance in the heritage overlay and apply controls depending on the necessity for protection. Each overlay has different controls. These include:
- Whether external paint controls apply
- Whether internal alteration controls apply
- Whether there are any tree controls
- Whether outbuildings or fences which are not exempt (whether they are of significance)
- Whether the building is on the Victorian Heritage Register
- If prohibited uses may be permitted
- If the place is and Aboriginal heritage place
Clause 43.01 – Heritage Overlay
In the Yarra Planning Scheme, Clause 43.01 – Heritage Overlay is a Victorian Planning Provision that outlines the requirements for land use and development on a place recognised as of heritage significance.
Schedule to Clause 43.01
The schedule to Clause 43.01 of the Yarra Planning Scheme specifies places within the City of Yarra that require heritage protections. These places are listed in the schedule and are categorised by heritage overlay numbers.
Zones
The planning scheme zones all land to reflect different land uses. These zones categorise how land is used and there are specific rules related to each zone.
Mixed Use Zone (MUZ)
The Mixed Use Zone allows residential and commercial use. This zone defines land use in and around the municipality’s public transport corridors and activity centres and generally allow for high density residential development and encourage a mix of land use.
Neighbourhood Residential Zone (NRZ)
The Neighbourhood Residential Zone is applied to largely low-scale residential neighbourhoods with special and intact neighbourhood character and heritage significance. Mandatory building heights in a NRZ is (9m / 2 storeys). This zone does not allow for significant residential growth.
General Residential Zone (GRZ)
The General Residential Zone is applied to select main roads and key boulevards that have experienced substantial redevelopment. Mandatory building heights in a NRZ is (11m / 3 storeys). This zone does not allow for significant residential growth.
Note – Where a number follows in a residential zone, different controls apply.
Commercial 1 Zone (C1Z)
The Commerical 1 Zone is applied to properties for commercial use. Residential use is permitted. This zone defines land use in and around the municipality’s public transport corridors and activity centres and generally allow for high density residential development and encourage a mix of land use.
Commercial 2 Zone (C2Z)
The Commercial 2 Zone is applied to properties for commercial use. Residential use is not permitted.
Public Park and Recreation Zone (PPRZ)
The Public Park and Recreation Zone is applied to parks and open space to recognise the area for public recreation and open space use and to protect areas of significance where appropriate.
Public Use Zone - Education (PUZ2)
The Public Use Zone 2 is applied to public education institutions.
