Complying with tobacco legislation

Retailers have a responsibility to prevent people under 18 years of age from purchasing tobacco or e-cigarette products.

Staff responsible for the sale of tobacco or e-cigarette products, must complete training every six months and sign a Training Acknowledgement form.

Our Environmental Health Officers conduct regular visits to tobacco and e-cigarette retailers to provide information and ensure compliance with the Tobacco Act 1987.

The Tobacco Act 1987 requires:

  • no sales to people under 18 years old
  • smoke free dining, including at outdoor food events
  • correct display and advertising requirements
  • smoke free areas around hospital, school and childcare entrances, playgrounds and under age sporting events
  • display of no smoking signage

Reporting issues with compliance

If you believe there is a breach of the tobacco laws in the City of Yarra, please submit a report to us and include the following information:

  • address of premises
  • description of issue
  • date of the offence

If the issue is occurring now call Yarra City Council 9205 5555 and ask to speak with our Public Health team.
