Amendment C197 – Adjustments to residential zones previously proposed for the residential growth zone

Council is proposing Amendment C197 to the Yarra Planning Scheme.

The land affected by the amendment is in eleven areas, in the General Residential Zone, Schedule 3 (GRZ3) located along main roads and, in one case, a larger site opposite a park, that were previously identified as potential sites for application of the Residential Growth Zone. The sites are generally located in Alexandra Parade, Fitzroy and Clifton Hill; Nicholson Street, Fitzroy North and Fitzroy; Queens Parade, Fitzroy North and Clifton Hill; Hoddle Street, Richmond; Punt Road, Richmond and Burnley Street, Richmond. The one non-main road site is located at South Terrace, Clifton Hill.

The Residential Growth Zone (RGZ) was proposed in mid-2014 as part of the wider process to introduce new residential zones across the municipality. When the State Government changed in late 2014 the new Minister for Planning decided not to proceed with the RGZ and applied the GRZ3 to these areas instead.

The amendment proposes to change the current General Residential Zone, Schedule 3 (GRZ3) and replace it with a different residential zone (Neighbourhood Residential Zone, Schedule 1 (NRZ1), General Residential Zone, Schedule 4 (GRZ4) or General Residential Zone, Schedule 2 (GRZ2)). The details of the changes and background to this process are explained in the attached Explanatory Report. The maps listed below show the changes in these areas. The proposed zones are generally more likely to restrict development than the current zone. They include mandatory height limits. The GRZ3 has discretionary 9 metre height limit.

Community consultation

Council sought community feedback on the Amendment in November/December 2015. 

Council decisions in response to submissions

Council considered fourteen submissions in response to the Amendment at the meeting 16 February 2016. It passed the following resolution:

1. That Council, having considered the submissions received in relation to Yarra Planning Scheme Amendment C197 in accordance with Section 22 of the Planning and Environment Act 1987 (the Act), split the Amendment into two parts as follows:

(a) Part 1 would include the following areas:

(i) 310-364 Nicholson Street, Fitzroy;

(ii) 104-248 Queens Parade, Fitzroy North;

(iii) 43-61 Queens Parade, Clifton Hill;

(iv) 406 Wellington Street & 56-100 Alexandra Parade, Clifton Hill;

(v) 199-327 Punt Road, Richmond; and

(vi) 244-342 (west side) & 187-367 (east side) Burnley Street, Richmond (excluding those areas in the Neighbourhood Residential Zone, Schedule 1); and

(b) Part 2 would include the following areas:

(i) 10-84 Alexandra Parade, Fitzroy;

(ii) 95-187 Hoddle Street, Richmond; and

(iii) 47 Murphy Street, 158-160 Kent Street, 177-179 Somerset Street, 86-134 (west side) & 97-115 (east side) Burnley Street, Richmond (north of Bridge Road).

2. That Council note that no submissions opposed to the Amendment have been received in relation to all the properties noted in 1 (a) above, and that therefore Council may adopt the amendments in relation to those properties.

3. That Council abandon the proposed Amendment as it relates to 892-900 Nicholson Street,

 & 3-9 Miller Street, Fitzroy North.

4. That Council abandon the proposed amendment as it relates to 1 South Terrace and 160 Gold Street, Clifton Hill;

5. That Council adopt Part 1 of Amendment C197 and submit it to the Minister for Planning for approval in accordance with Section 31 of the Act, and

6. That Council request the Minister for Planning appoint a panel to consider the submissions received for Part 2 of Amendment C197, in accordance with Section 23 of the Act.

Amendment C197 Part 1 has been submitted to the Minister for Planning for approval. 

Panel Report – Amendment C197 Part 2

Amendment C197 Part 2 was considered by an independent Panel which submitted a report 22 July 2016.
