2A and 2-30 Burnley Street and 520 Victoria Street, Richmond

A proposal for a redevelopment in Burnley and Victoria Streets, Richmond, is before the Victorian Civil and Administrative Tribunal (VCAT).

The proposal provides for the construction of a seven storey building which would include 63 apartments.

Developer Salta has appealed to VCAT against Council's failure to determine the application within 60 days. VCAT has scheduled a three day hearing which will begin on 26 September 2012.

Council received 21 objections to the proposal, with concerns raised about issues such as the proposed height, visual bulk and traffic.

Council's position

In July 2012, Council's Internal Development Approvals Committee determined that if Council had still been in a position to decide on the application, it would have refused to issue a permit.

The grounds for refusal would have been that the proposal fails to comply with the maximum preferred heights and design guidelines included in the Design Development Overlay for the Burnley Street West precinct, that the proposal fails to provide sufficient loading facilities for the commercial tenancies, and that the proposal fails to provide bicycle parking.

Council will now argue this position at VCAT. VCAT is expected to take into account Council's position as part of its decision-making.

The proposed development

The application from developer Salta provides for:

  • Development of the land for the construction of a seven storey building at the corner of Burnley and Victoria streets
  • Associated buildings and works to the constructed residential buildings, including additional car parking within the basement
  • The building to be used as 63 dwellings (no planning permit required for dwelling use), a food and drinks premises (café), a convenience shop and a community space
  • Waiver of the loading bay requirement.

The proposal seeks to replace plans for an approved six storey office building with a proposal for a seven storey residential building. The office building was approved in association with the three residential buildings along Burnley Street which are nearing completion. The  café, convenience shop and community space approved as part of the office proposal would be included in the proposed residential building.

The site is affected by the 520 Victoria Street, 2A Burnley Street and 2-30 Burnley Street, Richmond, Burnley Street West Precinct – Incorporated Plan.

The Incorporated Plan, approved by the Minister for Planning in 2011, overrides the car parking requirements in Clause 52.06 of the Yarra Planning Scheme. The Plan requires a minimum car parking requirement of one space per dwelling, with no requirement for visitor parking. The permit application proposes 418 car parking spaces for 418 dwellings (across all buildings within the development) which meets the requirements of the Incorporated Plan.
