Prescribed accommodation

Prescribed accommodation premises such as residential accommodation, motels, hotels, hostels, student dormatories and rooming houses need to be registered with Council in accordance with the Public Health and Wellbeing Act 2008.

Requiring these kind of businesses to be registered helps Council ensure they comply with certain regulations to prevent the spread of infectious diseases.

A rooming house that accomodates three or less people or any residential accommodation, motel, hotel, hostel or student dormatory that accommodates five or less people (excluding members of the operator's family) are not considered to be prescribed accommodation and do not require registration.

If you are opening, buying or selling a prescribed accommodation business you need to ensure the business is registered with Council.

Setting up a prescribed accommodation business

If you are proposing to open a new prescribed accommodation premises you must contact Council's Public Health Unit on 9205 5166 to find out about compliance requirements under the Public Health and Wellbeing Act 2008.

Step 1 - Planning Permits

The first step in the process is to ensure that the business you are planning is able to be conducted at your intended premises. Contact Council’s Statutory Planning Department on 9205 5373 to find out if any planning permits are required.

Step 2 - Building Permits

If you are intending on constructing a new building or making any structural changes to an existing building you will need to obtain the necessary building permits.  For further information contact Council’s Building Services Unit on Building 9205 5095.

Step 3 - Complete and lodge a registration application

You must register your prescribed accommodation business with Council. To do this, you must lodge a completed application form and pay an application fee. Along with your application form you are also required to to submit plans of the premises to a scale of at least 1:100 that show the proposed use and size of each room.

Step 4 - Premises layout

When Council receives an application for a prescribed accommodation business, an inspection of the proposed premises will be made to ensure all requirements are met.

Transferring the registration of a prescribed  accommodation business

If you are taking over the running of an existing prescribed accommodation business and you do not intend to make any changes to the business operation or premises you will need to fill in an transfer of registration application form.

If you are taking over an existing prescribed accommodation business and intend to make significant changes to the business operation or premises then you need to lodge an application to register a new business by following the steps outlined above.
