Yarra City Council prosecutes owner of American Pit Bull

Yarra City Council has prosecuted an Alphington resident after her American Pit Bull escaped from its home and killed a neighbour’s dog last May.

In a hearing at the Melbourne Magistrates’ Court last week, the resident was fined $3300 and ordered to pay $2800 in costs. The Pit Bull was destroyed soon after the attack.

Mayor Cr Amanda Stone said the Pit Bull’s owner was convicted of five charges. These related to the attack, the owner’s failure to declare the dog as a restricted breed, and her failure to comply with the special conditions that apply to a restricted breed in Victoria.

Cr Stone said the attack happened on 29 May 2008 when another Alphington woman was walking her two dogs along Coate Ave, Alphington.

“The Pit Bull escaped from its owner’s property, ran across the road and killed the woman’s shitzu maltese,” Cr Stone said.

“The woman was knocked to the ground but thankfully she and her other dog escaped physical harm.”

Cr Stone said under state legislation, the owner of a restricted breed dog such as the American Pit Bull must register their dog with their local Council as being of a restricted breed.

Dogs of a restricted breed must be desexed, and when outside the owner’s premises, must be muzzled and leashed and under the control of a person aged 17 or older. 

The owner must display prescribed warning signs at all entrances to the premises where the dog is kept, warning people that a restricted breed dog is kept on the premises.

When indoors or outdoors on the premises, the dog must be housed in such a way that it cannot escape, and that prevents it from injuring visitors.

Cr Stone urged any residents who had concerns that they were living near a dog of a restricted breed, and whose owners were not complying with the restrictions, to contact Council on 9205 5555.

“It is children and animals - those least able to protect themselves - who are most vulnerable when these dogs are not contained and under owner control as they should be,” Cr Stone said.
