
The Victoria Street East precinct is undergoing extensive private sector redevelopment. In November 2004 Council adopted the Victoria Street East Precinct Urban Design Framework (UDF) and resolved to request the Minsiter for Planning to approve Amendment C75 to the Yarra Planning Scheme to incorporate the UDF into the scheme on an interim basis.
The Victoria Street East Precinct Urban Design Framework (UDF) was eventually linked to the Planning Scheme through references to a later approved version dated 16 November 2005.

At the same time, private sector developer, Taras Nominess Pty Ltd (Salta Properties), requested that the Minister rezone three large parcels of land within the precinct (the MFB site, the area to the north and the properties along the west side of Burnley Street between Victoria Street and Buckingham Street) to a Priority Development Zone. In addition, Salta also lodged a planning application with the Minister for a development in Walmer Street, which Council had previously refused.
In November 2005, the Minister referred three key areas of the precinct to a Priority Development Panel (PDP) to investigate and provide planning advice.
The three areas were:
The Minister handed down his decision on the Walmer Street proposed development and Yarra Gardens and Shamrock Street areas in August 2007, and the Burnley Street West Precinct in December 2007.
The Minister for Planning approved the development of three, eight storey buildings “on legs” (with a one storey undercroft), only 13.5 metres from the crest of the Yarra River. He also rezoned the land to a Priority Development Zone (PDZ) removing Council from its role as the responsible authority for the future development of the land.
The Minister overturned Council’s decision to refuse the initial planning application, instead permitting a building height of 8 to 9 storeys with a three level basement car park.

The Minister has permitted the development of a six storey building, lowering to two storeys where it abuts current low level residential buildings. He has also upheld the current Residential 1 zoning for the site and allowed some office space at the corner of Burnley Street and Victoria Street.
At this stage, Council is yet to be informed if it will remain responsible for assessing any future development proposals for the precinct, or if the Minister will take control of the development. Council is also still awaiting information about its request for the inclusion of a community space within the precinct interfacing with Williams Reserve.
Before development can commence on any of the Victoria Street East sites, the developer must submit plans to the responsible authority (either the Minister or Council) for approval.
The Minister is also currently considering a Stage Two report from the Priority Development Panel. This report considers a number of other matters in relation to the precinct, such as traffic management issues, which were raised during the first stages of their investigations. It is expected that he will make a decision about these matters in the next few months. Council and local residents will be notified when this occurs.
Council will continue to pursue its role in integrated planning for the Victoria Street East Precinct to achieve the best possible outcome for this area and the local community.
