Amendment C97 – Cremorne and Church Street Precinct

Amendment C97 to the Yarra Planning Scheme proposes to rezone land within Cremorne, south of the east-west suburban railway lines and west of the area flanking Church Street between the Yarra River and East Richmond Station. The area also includes both sides of Church Street and properties within a Business 3 Zone on its eastern side, between the Yarra River and the railway line (see map below).

The Amendment proposes to make the following changes to the Yarra Planning Scheme in relation to the affected properties:

Submissions received during the public exhibition of this Amendment are currently being considered.

At its meeting on Tuesday 21 July 2009, Council resolved to defer making a decision regarding Amendment C97 so that a further report can be made to Council regarding the impact of the proposed rezoning from the Business 3 Zone to the Business 2 Zone.

At its meeting 22 September 2009 Council resolved:

    1. That, having further considered the implications of the proposed rezoning of specified land within the Cremorne and Church Street Precinct from Business 3 Zone to Business 2 Zone, Council retain the current Business 3 Zone and not adopt  the Amendment C97 to the Yarra Planning Scheme, pursuant to section 23 (c) of the Planning and Environment Act 1987, on the basis of the likely detrimental impact of such a rezoning on the Cremorne and Church Street Precinct as a key employment precinct in Yarra.
    2. That, pursuant to section 28 of the Planning and Environment Act 1987, Council advise the Minister for Planning of its decision to not adopt  Amendment C97 to the Yarra Planning Scheme.
    3. That Council inform all the submitters to Amendment C97 to the Yarra Planning Scheme and land owners and occupiers within the Cremorne and Church Street Precinct of Council’s decision to not adopt Amendment C97 and the reasons for this decision.
    4. That a further report be presented to Council regarding how any of the adopted recommendations of the Cremorne and Church Street Precinct Urban Design Framework could be implemented through the Yarra Planning Scheme.
    5. That a review of residential development in strategic redevelopment sites across Yarra and the long term demand for business and employment related zones in the municipality be conducted in 3 years time and be presented to Council.

Council officers are preparing a further report in line with point four of the resolution.
