Out of Hours Construction Permits

When can I conduct building works?
The times that building works are permitted are regulated by two things:

1 - Environment Local Law No.3, Section13:

A person is permitted to work the following hours –

  • Monday to Friday – 7.00am to 6.00pm
  • Saturday – 9.00am to 3.00pm
  • Sunday, ANZAC Day, Christmas Day and Good Friday – no work permitted.

This condition does not apply to any person to whom section 48A of the Environment Protection Act 1970 applies.  If you fall into this category, then you must comply with the provisions of the Environment Protection Act 1970 prescribed noise guidelines.  A copy of these guidelines can be obtained by contacting the Community Amenity Unit on 9205 5063 or visiting the EPA web site: http://www.epa.vic.gov.au/noise/.

2 - Planning permit conditions:

If your planning permit was issued prior to 11 March 2003, you will need to refer to your planning permit for your permitted times of work.  Council’s Urban Planning Branch can be contacted on 9205 5373.

Who can get an out of hours permit?
Out of hours permits are available to people who for specific reasons other than commercial consideration cannot undertake the proposed work during the standard times for construction. Permits will not be approved if the works to be carried out are not of an urgent nature or an emergency.

These reasons may include but are not limited to:

Each application costs $125.00 - payment is required prior to the date of commencement of the works or the permit is not valid.

How early do I need to submit an application?
Applications need to reach the Community Amenity Unit at least 7 days in prior to the date of works. All out of hours permits in residential areas and some in commercial / industrial areas will include the condition that all affected neighbours/businesses must be letterbox dropped and informed of the date, time and nature of the works. In most cases, Council will require a minimum 5 days notice be provided.
