North and south of Johnston Street, between Smith and Brunswick Streets
At its August 2010 Council meeting, Council adopted Amendment C113 to the Yarra Planning Scheme. The Amendment was approved by the Minister for Planning and gazetted on 20 January 2011.
The Amendment rezones the land located to the north and south of Johnston Street, generally between Smith and Brunswick streets, from Business 3 Zone (B3Z) to Business 2 Zone (B2Z), and applies an Environmental Audit Overlay (EAO) and a Design and Development Overlay (DDO).
The Amendment also rectifies the zoning anomaly that affects the properties at 1/214 Argyle Street, Fitzroy (Lot 1 PS 324484) and 2/214 Argyle Street, Fitzroy (Lot 2 PS 324484). Currently both properties are partly covered by a Business 1 Zone and partly covered by a Business 3 Zone. The Amendment includes both lots in the Business 1 Zone.
Council sought public feedback on the proposed Amendment in late 2009 – early 2010. After receiving seven submissions, Council requested that the Minister for Planning convene an independent planning panel. In May 2010, the panel heard from all people who wished to make a submission. Following the hearing, the panel recommended the Amendment be adopted but suggested Council consider minor changes such as deleting unnecessary sections in the DDO and changing the way in which the Smith Street Structure Plan is referred to.
