Victoria Street East Precinct

In November 2004 Council adopted the Victoria Street East Precinct Urban Design Framework (UDF) and resolved to request the Minister for Planning to approve Amendment C75 to the Yarra Planning Scheme to incorporate the UDF into the scheme on an interim basis.

The Victoria Street East Precinct Urban Design Framework (UDF) was linked to the Planning Scheme through references to a later approved version dated 16 November 2005. A copy of the UDF can be found here:

At the same time, private sector developer Taras Nominees Pty Ltd (Salta Properties), requested that the Minister rezone three large parcels of land within the precinct (the MFB site, the area to the north and the properties along the west side of Burnley Street between Victoria Street and Buckingham Street) to a Priority Development Zone. In addition, Salta also lodged a planning application with the Minister for a development in Walmer Street, which Council had previously refused.

In November 2005, the Minister referred three key areas of the precinct to a Priority Development Panel (PDP) to investigate and provide planning advice.

The three areas were:

  • The Burnley Street West precinct
    The Burnley Street West precinct is bounded by Victoria Street to the north, Burnley Street to the east, Buckingham Street to the south and a right of way located at the rear of properties fronting Burnley Street to the west. 
  • Yarra Gardens and Shamrock Street precinct
    This precinct is bounded by Flockhart Street to the west, Victoria Street to the south, Walmer Street to the east and abuts the northern boundary of 18 Flockhart Street to the north. This precinct includes the Metropolitan Fire Brigade (MFB) site.
  • Walmer Street Development Proposal
    The proposed development is situated on the north east corner of Walmer Street and  Victoria Street and abuts the Yarra River.

The Minister handed down his decision on the Walmer Street proposed development and Yarra Gardens and Shamrock Street areas in August 2007, and the Burnley Street West Precinct in December 2007.

The Minister's Decision

Yarra Gardens and Shamrock Street Precinct
The Minister for Planning approved the development of three, eight storey buildings “on legs” (with a one storey undercroft), only 13.5 metres from the crest of the Yarra River. He also rezoned the land to a Priority Development Zone (PDZ) removing Council from its role as the responsible authority for the future development of the land.

Walmer Street Development
The Minister overturned Council’s decision to refuse the initial planning application, instead permitting a building height of 8 to 9 storeys with a three level basement car park.

Burnley Street West Precinct
The Minister has permitted the development of a six storey building, lowering to two storeys where it abuts current low level residential buildings. He has also upheld the current Residential 1 Zoning for the site and allowed some office space at the corner of Burnley Street and Victoria Street.

Next Steps

Council will continue to pursue its role in integrated planning for the Victoria Street East Precinct to achieve the best possible outcome for this area and the local community.
