221 Kerr Street, Fitzroy

An objection to Council's decision to grant a permit for a proposed eight-storey residential development at 221 Kerr Street, Fitzroy has been settled via mediation at the Victorian Civil Administrative Tribunal (VCAT).

Council issued a Notice of Decsion in January 2013 that it would permit the proposal from PhilKerr Property Pty Ltd and BillKerr Property Pty Ltd that would involve retaining the existing two-storey red brick facade and constructing six additional levels.

Both the applicant and objectors appealed against the decision and a mediation session was held on 17 July 2013 where the matter was resolved.

 

The proposal 

In its current form, the proposal is for the part demolition and construction of alterations and additions, resulting in an 8 storey building, with a reduction in the car parking requirements associated with dwellings (no planning permit required for dwelling use). 

Amendments to the original plans included the following changes:

  • a reduced building height in the south-west corner of the site (adjacent to the Kerr and Gore Street intersection)
  • a reduced number of dwellings (from 72 to 64)
  • a roof top garden at level 5 (adjacent to the Kerr and Gore Street intersection).

Outcome of mediation

A permit was granted in accordance with Council's decision on 24 January 2013 subject to the following amendments:

  • Delete 1(g) and replace with: Materials and finished to the northern elevation of the eastern most building Levels 3 to 6 be of colour of light to mid tone and be a non-reflective material to minimise glare to the satisfaction of the responsible authority.

  • Replace condition 1(c) with: Louvered windows to internal facing bedrooms and studies revised from clear to obscure glazing to a minimum height of 1.7m. Where these windows are within a 45 degree arc and 9m radius of another habitable room window or private open space area, the louvers must be fixed to a minimum height of 1.7m or suitable alternative to the satisfaction of the responsible authority.

  • Replace condition 1(e) with: A sliding door/wall to the south of the dwelling 102 study or suitable alternative to the satisfaction of the responsible authority.

  • Replace condition 1(f) with: That the skylights to the level 1 bedrooms (dwelling 004 – 006) as openable or vented.

  • Replace condition (h) with: A minimum 1 store per dwelling with a minimum area of 3m³ to be provided in over-bonnet arrangement or otherwise to the satisfaction of the responsible authority.

  • Replace 1(r) with: Provision of a minimum 3 on-site visitor car parking spaces.

  • Replace condition 7 with: Before the plans are endorsed, a desktop wind assessment report to the satisfaction of the responsible authority must be submitted to and approved by the responsible authority. When approved, the report will be endorsed and will form part of the permit. The report must be prepared by a suitably qualified person and must include a wind study of all communal areas and publicly accessible areas and confirm that the surrounding public spaces and internal communal spaces will be within the criterion for walking comfort.

  • Delete conditions 26, 27 and 28 (consequently re-number condition 29 to 26).
