Clearways court decision

Yarra City Council had lived up to its obligation to the local community by asking the Supreme Court to review decisions made by VicRoads and the Minister for Roads and Ports about extended clearways, the Council said today.

Mayor Cr Jane Garrett said the Council did not regret taking the action even though the Court had today found in favour of VicRoads and the Minister on the majority of issues in dispute.

Cr Garrett said Justice Robert Osborn had set a directions hearing for Monday 25 October to decide what further steps should be taken in relation to what is left of the proceedings. One of the matters still to be resolved is whether the Councils wish to put forward evidence that the Minister had been “manifestly unreasonable” to direct VicRoads to extend clearways  

She said the Court had found in the Councils’ favour on the matter of whether the Court had the power to review the Minister’s decision.

“Council stood up for our local traders and their employees, who are very concerned about the impact of clearways on their livelihoods,” Cr Garrett said.

“The Court has agreed today that Yarra and Stonnington Councils were well within our rights to take this action on behalf of our community,” she said.

Cr Garrett said the Councils would meet jointly in coming days to discuss the next steps in the matter.
